Terms of Service
Effective date: August 27, 2026 Last updated: August 27, 2026
Intro: These Terms of Service (“Terms”) are a legal agreement between you and Fortify Practice (“Fortify Practice,” “we,” “us,” or “our”). They govern your use of fortifypractice.com (the “Site”) and our AI phone receptionist service, “Lucy” (the “Service”). By using the Site or the Service, you agree to these Terms. If you do not agree, do not use them.
Please also review our Privacy Policy and Cookies Policy.
Who may use the Service
The Service is intended for dental practices and business users. You must be at least 18 and authorized to enter into these Terms on behalf of your practice or organization. If you use the Service for a dental practice, you represent that you have authority to bind that practice.
What the Service is
Lucy is an AI phone receptionist for dental practices. She answers inbound calls, handles common front-desk requests, and books, reschedules, or cancels appointments in your practice-management system (such as Open Dental, Dentrix, or Eaglesoft). Related features, such as missed-call follow-up and reporting, are part of the same Service.
Lucy is a software tool that assists your front desk. She is not a person, not a medical professional, and does not provide dental, medical, or emergency advice. You remain responsible for your practice’s clinical decisions, patient communications, and compliance obligations.
Fees, billing, and cancellation
- Subscription: $997 per month.
- Setup: a one-time $1,600 setup fee.
- Usage: per-minute usage charges for the minutes Lucy spends on calls, billed in addition to the monthly subscription.
- No contract: the Service is month-to-month. You may cancel at any time, effective at the end of your current billing period.
Billing terms:
- Fees are billed in advance for the subscription and in arrears for usage, to the payment method on file.
- Fees are exclusive of applicable taxes, which you are responsible for.
- Except where required by law, fees already paid are non-refundable, including the setup fee once setup work has begun.
- We may change pricing on a going-forward basis with advance notice; changes take effect at your next billing cycle.
Your responsibilities and acceptable use
You agree to:
- provide accurate account and practice information;
- use the Service only for lawful purposes and in compliance with applicable laws, including telephone, recording-consent, and healthcare-privacy laws;
- maintain your own systems (including your practice-management system) and provide the access needed for Lucy to function;
- be responsible for activity under your account and for your staff’s use; and
- obtain any patient notices or consents your practice is required to provide (for example, call-recording notices where required).
You agree not to:
- use the Service to violate any law or third-party right;
- attempt to reverse-engineer, resell, or interfere with the Service;
- upload malicious code or attempt to gain unauthorized access; or
- use the Service in a way that overburdens or disrupts it.
Patient data and HIPAA (Business Associate)
Where Lucy handles patient information for your practice, we do so as your Business Associate under a separate, signed Business Associate Agreement (BAA). The BAA, not these Terms, governs the handling of Protected Health Information (PHI). If there is a conflict between these Terms and the BAA regarding PHI, the BAA controls.
You are responsible, as the covered entity, for your own HIPAA obligations to your patients.
Intellectual property
We own the Site, the Service, Lucy, and all related software, content, and trademarks. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. You keep ownership of your practice’s own data and content. You grant us the limited rights needed to operate and improve the Service, consistent with our Privacy Policy and the BAA.
Service availability and changes
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and we may perform maintenance. We may also update these Terms; material changes will be posted with a new “Last updated” date, and continued use means acceptance.
Disclaimers
THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that Lucy will correctly handle every call, capture every detail, or never make an error. Lucy is an automated assistant and is not a substitute for professional judgment or a live emergency line.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12-MONTH PERIOD BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your violation of law or these Terms, or your failure to meet your own obligations to your patients.
Term and termination
These Terms apply while you use the Site or Service. Either party may terminate the subscription consistent with Section 4 (month-to-month, cancel anytime). We may suspend or terminate access for violation of these Terms or non-payment. On termination, your right to use the Service ends; data return/deletion is handled per our Privacy Policy and the BAA.
Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
Miscellaneous
These Terms, the Privacy Policy, and (for PHI) the BAA are the entire agreement between us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.
